Returns, Refunds & Cancellations
This policy explains the main rules for change-of-mind cancellations, physical returns, digital products and faulty or incorrect orders.
Physical goods: change of mind
If you are buying as a consumer and the statutory distance-selling cancellation right applies, you may cancel an eligible order within 14 days after the day on which you receive the goods.
To cancel, send a clear statement to gareth@garethmclearnon.com before the cancellation period expires. You do not have to use the model cancellation form below, but you may do so.
After notifying us, return the goods within the period required by law. For UK consumer cancellations, this is normally within a further 14 days.
Unless we have agreed otherwise or the goods are faulty, you are responsible for the direct cost of returning an eligible change-of-mind return. Please contact us before sending anything back so that we can provide the correct current return instructions and return address.
Refunds for cancelled physical orders
Where the statutory right of cancellation applies, we will refund the price paid and, where required by law, the cost of our least-expensive standard delivery option.
We do not have to refund any additional delivery cost caused by the customer choosing a more expensive method than our standard delivery option.
For returned goods, a refund may be withheld until the goods are received back or until the customer supplies evidence that they have sent them back, whichever occurs first, where the law permits this.
A lawful deduction may be made for diminished value caused by handling beyond what is reasonably necessary to establish the nature, characteristics and functioning of the goods.
Personalised or made-to-order products
The statutory change-of-mind cancellation right may not apply to goods made to the customer’s specifications or clearly personalised for that customer.
This may include a score carrying a customer-specific dedication or another individually requested customisation.
A standard product is not treated as personalised merely because it carries the composer’s ordinary signature unless it has genuinely been customised for the individual purchaser.
Rights relating to faulty, damaged or misdescribed goods are unaffected.
Digital downloads
For downloadable scores, backing tracks, recordings and other digital content, the cancellation right may be lost once supply begins where applicable law permits this and the customer has first expressly consented to immediate supply and acknowledged the resulting loss of the cancellation right.
Where that consent has validly been obtained, a digital product that has begun downloading or has been accessed is normally not refundable merely because the customer changes their mind.
If the required consent was not obtained, or if digital content is faulty, corrupted, materially misdescribed or not supplied correctly, statutory rights remain unaffected.
Faulty, damaged or incorrect orders
If an item arrives damaged, is faulty, differs materially from its description or you receive the wrong product, contact gareth@garethmclearnon.com with your order number and, where useful, photographs or screenshots.
We will deal with the issue in accordance with the consumer rights that apply to the transaction.
Services
If you purchase a service and ask us to start work during a statutory cancellation period, you may be required to pay for the proportion of the service already supplied if you later cancel, where applicable law permits this and the necessary request or consent has been obtained.
